This document is about the Organic Law of Education (LOE), and it reflects the different topics that this Law defend related to education. It is about the different contents of this Law and some questions about the topic.
It is a difficult work because it's a Organic Law and it's difficult to summarize (all the information is important) so we had to select the more relevant data.
In 1970, most of the children weren’t in school, but nowadays this problem has been solved. Despite of that, there was other problems, and for solve them, there were ten organic laws of education: LOECE, LRU, LOGSE, LOPEG, LOCE, LODE, LOU, Professional Formation Law, and finally LOE.
The
LOE was a law to achieve a consensus. It wasn’t a constitutional impugnation
object, it could be a prudent law that chase the educational system stability
and arrange the reforms made.
It
is a law that assume some principles, criteria and structures from the other
laws repealing such as LOGSE, LOPEG or LOCE, adding new problem solutions
detected by the educational community.
There
are two principal aims that this law chase:
-Reinforce the incurred achievements in the
last thirty years.
-Think the correct way to face mistakes made
and do the necessary modifications.
If
those aims would be achieved, this law would solve the most important problem
of the educational system: achieve the high education quality with most social
equity as much as possible.
According
to this law, the essential education will be primary and secondary education.
The government will fix basic competences, contents and evaluation criteria,
the educational administrations will establish the curriculum and schools will
develop the curriculum in the different stages.
Primary
education will be organized in areas with a global character, and educational
administrations could add a second foreign language. Tutors will guide the
individual and collective educational process of students.
The
evaluation will be continuous and global, and students could pass to the next
stage, when will be considered that they have achieved the basic competences.
They could receive necessary support if they didn’t achieve some of the
objectives.
This
law include curriculum diversifications from the third year of secondary
education, to those students who require it and to students in second year of
secondary education that aren’t in conditions to pass or students that have
repeated one time in secondary.
In
the second year of secondary education, all schools will do a diagnostic
evaluation.
According
to the LES, all initial professional qualification programmes will include
three types of modules:
-Specific
modules refer to competence units of the level qualifications.
-Formative
and general character modules that expand basic competences and improve the
transition of the educational system to the labour market.
-Voluntary
character modules to students that wanted to get the Secondary Education Title.
Graduate degree in secondary
education
· This degree will be obtained by these
students who acquire the basic competencies and the objectives of this stage.
· This
degree allow students to log on baccalaureate, medium-degree professional
training and labor market.
·
Students who don’t obtain this degree will receive a schooling
certificate with the studied years.
·
Students can stay studying baccalaureate in an ordinary regime for four
years.
Organization
· These
are the baccalaureate modalities:
-Art
-Science
-Humanities
and social sciences
·
Baccalaureate is organized in common subjects, modality subjects and
optative subjects.
· Common
subjects in Baccalaureate are:
-Sciences
for the contemporary world.
-Physical
education.
-Philosophy
and Citizenship.
-History
of philosophy.
-History
of Spain.
-Spanish
language and literature.
-Foreign
language.
· This
degree will be obtained by the students who have a positive evaluation in all
the subjects of the two courses.
University
access test
· To
enter University students must pass a test which is valued objectively with the
baccalaureate marks.
· This
test can be done by the students who have obtained the Baccalaureate degree.
Professional
training
·
Medium-degree professional training could be studied by these students
who have obtained the secondary degree and superior-degree could be studied by
these students who have obtained the Baccalaureate degree.
· They
may also access to professional training students who, lacking the academic
requirements, pass an entrance exam regulated by the Education Administrations.
Talking about the
evaluation, titles and convalidations of different courses:
With this law, to
overcome the vocational training cycles at the different levels basic,
intermediate and higher it was necessary to overcome all subjects.
When you had passed the
basic training cycle, you receive the title of Technician basic professional,
but if you wanted to get into the middle and higher cycles you had to pass a
test grade admission.
But if you have the
intermediate degree that allow you a direct access to all types of
baccalaureate.
With the highest
degree you obtain the title of Higher Technician, that allow you a direct
access to the university.
If these cycles are
not exceeded in its entirety, the approved subjects were certified
As to those people who
complete higher studies in music, dance, drama, Preservation and Restoration of
Cultural Property, plastic arts studies or higher studies in design, were
equivalent as a degree of a university.
It was also compulsory
that education authorities organized at short intervals (periodically) tests
for people over 18 who wish to obtain the degree in Secondary Education (ESO)
provided they have reached previously basic skills.
It also could obtain
the title of baccalaureate or vocational training directly, but in this case
you had to be over 21 years.
LOE also talks about
that in any case would be any discrimination on grounds of birth, race, sex,
religion or any other personal or social circumstance. This one includes
schools where education is differentiated by sex always provided is in
accordance with the fight against discrimination.
As for the admission
of pupils in schools, the students that have priority were the transfer of the
household or either parent with a high degree of mobility due to the public
service they provide.
As for the
organization of the baccalaureate, will do it the education authorities so they
can make an educational offer adapted to your needs.
With this law they
promote intended actions to promote quality of schools, centres had to make a plan
to improve the quality of their centre, such as teacher training, improved
school performance, attention to students with specific educational support
needs, the incorporation of digital teaching resources. And the headmaster had
complete autonomy to make changes as necessary.
The school council as
stipulated in the LOE must take measures to: evaluate projects and standards,
to report on the admission of students, knowing the resolution of disciplinary
conflicts, proposing measures to promote the coexistence of central and
conservation facilities
While the headmaster
was in charge of directing and coordinating all activities of the centre, a
pedagogical exercise leadership, promote coexistence centre, promote
collaboration with families, support projects and general programming.
The headmaster is chosen by the
others teachers and the administration. Inthis way, the selected candidate
will be who has the great support of the otherteachers and the best qualificated.
The assessment will be done by Instituto
de Evaluación and Administraciones educativas. The government will decide the
structure and functions of Instituto de Evaluación.
Teachers and the management team will help
Administraciones educativas in the assessments of their high schools and schools.
The assessment are based on the
basic competences of the curriculum.Theassessment is continue.
The universities, do process to students who want to
study there, they can do.
Universities have to respect the principles of
equality, capacity and merit.
